PRIVACY POLICY

This Privacy Policy (“Policy”) describes Vari’s use and sharing of personally identifiable and other sensitive information submitted by the Users, such information being related to you or other persons downloading, accessing or using Vari. The Services offered adhere to all the laws, rules, regulations and policies pertaining to the jurisdiction (“Applicable Laws”) with regard to the collection, use, disclosure, retention and protection of User information including Personally Identifiable Information (as described hereinafter), that Vari is likely to have access to as a result of your use of it.

By accessing Vari, you hereby acknowledge and consent to the collection, use, disclosure and storage of your own Personally Identifiable Information, as received by Vari by virtue of your usage of Vari in the manner described in this Policy. In addition, you also agree to be bound by the terms and conditions of this Policy while using or accessing Vari. If you do not agree with the terms of the Policy, you should not access or use the Vari strictly.

1. INFORMATION COLLECTED FROM THE USER

1. Personally Identifiable Information refers to any data, whether true or not, from which you can be identified including without limitation, your name, gender, business name, its address, email address, date of birth, date of incorporation, any identity proof number, phone number etc., to which Vari has or is likely to have access. Personally Identifiable Information also includes any financial information provided by you either during registration with Vari or at the time of making payment through the payment gateway associated with Vari. Vari may also have access to information of third parties during the course of providing the Services to you, which will be included in the Personally Identifiable Information. Vari may also collect recurring information of your geographic locations on a continuous basis.

2. Vari collects such Personally Identifiable Information from the User because you voluntarily submit information in order to enjoy the Services. Personally Identifiable Information may be obtained from the User for such purposes and in the manner including but not limited to the following:-

1. When you visit Vari for registration and for using the Services;

2. When you submit the Listing on Vari; and

3. When you receive customer or technical support from Vari.

3. Vari may also collect anonymous data that is not associated with or linked to any Personally Identifiable Information (“Anonymous Data”) and which, by itself, does not permit your identification. Vari collects one or more unique identifiers of the device where it is installed, such as details of network, type of connectivity and such other information. Vari may store this unique identifier and create a profile for you. This is only maintained to provide you with updates of the Services.

4. In addition to any Personally Identifiable Information that you to submit to Vari, Vari may use a variety of technologies that automatically (or passively) collect certain information, including but not limited to usernames, passwords, and other security and usage related information, whenever you visit Vari or utilize the Services (“Usage Information”). Vari may automatically receive and record information that is sent by your platform whenever you access. Vari may automatically collect and record certain technical information that you do not visibly enter and that is automatically collected during your use of the Services, such as Log Data, Analytical Code, Time Stamp, Geo Stamp, IP address, version and identification number of the device, browser type, browser language, the date and time of your request, your profile, websites visited by the you, search terms used, your mobile carrier data, platform type, number of clicks, phone number, requested status of other Users, and various status information with regard to the Services provided through Vari. Such technical information collected is not associated with any Personally Identifiable Information and is only tagged to the unique identifier for a particular device.

5. Vari may use data collection devices such as “cookies” on the User’s mobile device or other device drive that assist Vari in providing Services.

2. USE OF PERSONAL INFORMATIONCOLLECTED

1. Vari may use the Personally Identifiable Information and other information collected for any of the following purposes including without limitation:

1. to effectively provide the Services to the Users;

2. for the purposes of software verification or administering software upgrades;

3. to allow the User to participate in surveys regarding Services;

4. to maintain the quality of the Services and provide general statistics regarding their use;

5. to deliver Services, including email notifications, confirmations, technical notices, updates, security alerts, and support and administrative messages that the User may request;

6. archival or backup purposes;

7. to alert the Users about updated information and other such new or updated services that may be offered by other Users;

8. to allow access to exclusive features or functionality of Vari; and

9. to resolve disputes and troubleshoot problems.

3. DISCLOSURE OF PERSONAL INFORMATION

1. Vari may share the Personally Identifiable Information received from you with Vari’s other corporate entities and affiliates in connection with matters relating to the consumption of Services to help detect and prevent identity theft, fraud and other potentially illegal acts; correlated or multiple accounts to prevent abuse of Services; and to facilitate joint or co-branded services that the you may request where such services are provided by more than one corporate entity other than Vari. Such other corporate entities, affiliates, agents, suppliers and service providers may use the Personally Identifiable Information or other information submitted/provided by you only for the limited purposes as mentioned in this Policy.

2. Vari may disclose Personally Identifiable Information, if required to do so by law or regulation; to its legal counsel, law enforcement officers, governmental authorities who have asserted their lawful authority to obtain the information or where Vari has in good faith reasonable grounds to believe that such disclosure is reasonably necessary to enforce its Terms of Use or this Privacy Policy and the information could be useful in the investigation of unlawful activity, or to comply with a subpoena or warrant or an order made by a court, person or body with jurisdiction to compel the production of information, or to comply with court rules regarding the production of records and information.

Vari will not rent, sell, or otherwise provide Personally Identifiable Information received from the User to third parties without consent of the User, except as described in this Policy or as required by law. However, Vari and its affiliates reserve the right to share, sell and transfer some or all of the Personally Identifiable Information to other business entities should it, or its assets, plan to merge with, or be acquired by that business entity.

4. SECURITY OF PERSONAL INFORMATION

Vari has implemented commercially reasonable physical, managerial, operational and technical security measures to protect the loss, misuse, alteration and security of your Personally Identifiable Information in Vari’s care. Vari’s security practices and procedures limit access to Personally Identifiable Information on need to know basis only. Such measures may include, where appropriate, the use of firewalls, secure server facilities, implementing proper access rights management systems and processes, careful selection of processors, standard authentication and encryption policies for its servers and other technically and commercially reasonable measures.

2. Vari is committed to protecting the security of any Personally Identifiable Information and uses reasonable efforts including a variety of security technologies and procedures to help protect such Personally Identifiable Information from any unauthorized access, use or disclosure. Vari will take all reasonable measures in furtherance of the above commitment. However, it cannot guarantee that the Personally Identifiable Information received from you and other information stored on the servers will be absolutely protected. Vari’s systems and the communications networks through which you access the Website may be subject to security breaches and failures due to circumstances beyond its reasonable control. These may include "hacking", data theft or and physical theft among others. In such situations, Vari will try to rectify the problems as soon as possible.

3. Any data destroyed shall be disposed of in a manner that protects the privacy of the Personally Identifiable Information received by Vari from you in an appropriate manner as per the industry standard practices and norms.

4. You hereby acknowledge and understand that all Personally Identifiable Information provided in using the Website is with their knowledgeable consent and at the User’s own risk.

5. USER OBLIGATIONS

1. As a registered User of the Services, you have certain obligations to other Users. Some of these obligations are imposed by applicable law and regulations, and others have become commonplace for Services as offered by Vari:

1. You must, at all times, abide by the terms and conditions of the then prevailing Privacy Policy and Terms of Use. This includes respecting all intellectual property rights that may belong to third parties;

2. You must not upload or insert any comments that may be deemed to be injurious, violent, offensive, racist or xenophobic, or which may otherwise violate the purpose and spirit of Vari , Vari and its community of Users;

3. You must keep your username and passwords confidential and not share it with others;

4. All information given must be genuine and true to your best knowledge. Varishall not be held responsible in case of any fraudulent information given at the time of registration for using the Website.

2. Any violation of the guidelines as mention in this Clause 5.1 may lead to the restriction, suspension or termination of your account at the sole discretion of Vari.

6. INTERNATIONAL TRANSFER OF DATA

In the process of providing you the Services, Vari may transfer the Personally Identifiable Information and other information that it collects to affiliated entities or other third parties across borders, and from your country or jurisdiction to other countries or jurisdictions around the world. You understand, acknowledge and consent to transferring information and permitting the transfer of information, including Personally Identifiable Information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction. You hereby consent to the transfer of your information across countries or jurisdictions around the world.

7. GOVERNING LAW

The usage of the Services is exclusively governed by the laws of India and the jurisdiction of the courts in Vijayawada, Andhra Pradesh. Vari expressly disclaims any implied warranties or liabilities imputed by the laws of any other jurisdiction.

8. MODIFICATIONS

Any changes in this Policy by Vari will be posted on the its Website to reflect changes in its policy so that you are always aware of what information Vari collects, uses, and under what circumstances, if any, Vari may disclose it. You are advised to periodically review the abovementioned page for the latest information on Vari’s privacy practices. Once posted, those changes are effective immediately. To ensure and maintain standards of data protection and information security, Vari will secure the information provided by you in accordance with Applicable Laws and industry standards and technology to protect the loss, misuse, and alteration of your information under Vari’s control. Once your information is in Vari’s possession, Vari adheres to strict security guidelines, protecting it against unauthorized access.
